01Custom work is paid work

Our fees pay for professional time, expertise, and delivery against an agreed scope. We do not offer a satisfaction guarantee or a general change-of-mind refund once authorised work has begun. Choosing not to use completed work, changing direction, finding a cheaper supplier, or abandoning your business plans does not make earned fees refundable.

This policy applies to services supplied by Hanif Developments trading as Daripada. Read it with your accepted quotation and our Terms & Conditions. Specific written refund terms agreed for your project take priority, subject to applicable law. The protections in “Your statutory rights” below apply throughout this policy.

02Deposits and commencement

We normally require an agreed initial payment before work starts. Work starts when we begin authorised discovery, research, planning, design, technical setup, development, or other project activity; it does not have to wait until coding or launch.

Once work starts, the part of your deposit earned through that work and approved non-recoverable costs is non-refundable. A separately quoted capacity-reservation fee may also be retained where expressly accepted in advance, reasonable, and lawful. Calling an advance a “deposit” does not automatically make the whole payment earned.

If you cancel before any work starts, we deduct only approved non-recoverable costs and any expressly agreed, reasonable reservation charge that may lawfully be retained. The remaining advance is returned.

03Work and milestones already completed

Fees for authorised work already performed and completed contractual milestones are non-refundable for a change of mind. This includes discovery reports, design concepts, prototypes, implementation, testing, setup, revisions, and project management, even if you decide not to launch.

Approval of a stage does not include an unlimited right to reverse that stage without further fees. New preferences, changes after approval, or requests outside the accepted scope are quoted separately. This does not prevent you from reporting an actual failure to meet an agreed requirement.

04Cancelling a project in progress

Send a clear cancellation request to [email protected]. We will stop avoidable new work after receiving it and prepare an account of the work performed, committed third-party costs, and any lawful agreed reservation charge.

Work is valued using the agreed milestone allocation or rates. Where these do not resolve a partially completed stage, we use a reasonable, documented value of the authorised work within the agreed scope. We do not retrospectively invent a cancellation percentage or charge twice for the same work or cost.

Payments already made are applied to that amount. If the amount exceeds what you paid, the properly due balance remains payable. If you paid more than the earned fees and lawful costs, we refund the unearned difference. A whole advance is not forfeited merely because a project was opened.

Delays caused by missing client materials, feedback, approval, or payment do not by themselves entitle you to a refund of completed work. Any restart fees must be agreed separately.

05Domains, licences, and third-party costs

Domain registration and renewal, hosting commitments, software licences, stock assets, paid API credits, email services, and other approved third-party purchases are generally non-refundable once ordered or committed where the provider does not return the charge.

We do not guarantee a third-party refund. If a provider returns a project-specific charge to us, we pass on the recoverable amount after any lawful, previously disclosed deductions. Unspent third-party funds we hold for you are included in the cancellation account. Advertising budget already spent with a platform is not refundable by Daripada; unused budget held by us is returned.

Unavoidable transaction charges are deductible only if disclosed in your agreement and permitted by law. We do not deduct them from refunds arising from our own billing error or a remedy the law requires us to provide.

06Hosting, maintenance, and support plans

Unless your order or applicable law says otherwise, fees for a correctly billed service period already begun are non-refundable and are not prorated because you stop using the service early. The paid service remains available until its scheduled end, subject to the agreement.

Cancel an automatic renewal by the agreed cutoff, or, if none is stated, by emailing us before the next billing period begins. Cancelling a payment instruction alone does not communicate cancellation of an agreed minimum term. Any minimum term must have been disclosed and accepted before purchase.

We correct duplicate charges, charges taken after an effective timely cancellation, and charges for a service period we are unable to supply. Any refund or credit for an outage is assessed under the agreed service terms and applicable law.

07Defects, non-delivery, and billing errors

If something does not meet the agreed scope, describe the issue and give us a reasonable opportunity to investigate and correct a remediable failure. A verified defect is treated differently from a change in preference. Minor correctable defects do not automatically cancel the whole project or make all completed stages refundable.

If we cannot supply the agreed service, discontinue it for reasons unrelated to your breach, or fail to resolve a material breach within an appropriate time, we will account for unprovided services and provide the refund or other remedy required by the agreement or law. This process does not delay an immediate statutory remedy where one applies.

08How to raise a refund request

Email [email protected] with your name, project or website, invoice reference, the payment in question, the reason, and any supporting details. Raise concerns promptly so we can check the records.

We aim to acknowledge requests within five business days and give an assessment within ten business days after receiving the information reasonably needed. Approved refunds are normally initiated within 14 business days using the original payment method where practicable. Your bank or payment provider may take additional time. A shorter deadline required by law takes priority.

We may verify the payer and payment details to prevent fraud. Contacting us does not waive or remove any right to use a payment provider’s dispute process, a tribunal, or a regulator.

09Your statutory rights

Our commercial policy is strict about change-of-mind cancellations and payment for work actually performed. It does not exclude, restrict, or replace any consumer guarantee, cancellation right, refund, or other remedy that cannot lawfully be excluded under Malaysian law or other applicable mandatory law.

Where a statutory remedy applies, it takes priority over the deposit, completed-work, subscription, third-party cost, and processing provisions above. No wording in this policy makes an otherwise unlawful penalty or unfair term enforceable.
